These Terms of Service ("Terms") govern your access to and use of the Grace's Desire mobile application and website (collectively, the "Service"), operated by Elsen Technologies UG (haftungsbeschränkt), Fliederweg 7, 34212 Melsungen, Germany ("we", "us", or "our"). By creating an account or using the Service you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
The Service contains sexual and explicitly adult content, including mature language and imagery. You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to create an account or use the Service. Use by minors is strictly prohibited. By creating an account you represent and warrant that you meet this age requirement.

You retain ownership of any content you voluntarily submit through the Service (e.g., story submissions). By submitting content you grant us a worldwide, non-exclusive, royalty-free licence to use, store, and display that content solely for the purpose of operating the Service. We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without notice.
Certain features require a paid subscription ("Premium"). All purchases are processed through the Apple App Store or Google Play and are subject to their respective terms and conditions. Key points:
We collect only the minimum personal data necessary to provide the Service, including your email address, username, password hash, and an optional date of birth for age verification. We also store a push notification token if you grant permission, and anonymised usage counts to improve the app. Full details are set out in our Privacy Policy.
Data processing is conducted under the legal bases of your explicit consent and our legitimate interests, in accordance with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).
Interaction data (e.g., quiz completions, article views) may be used in anonymised and aggregated form to improve the Service. Such data cannot be traced back to individual users and is not shared with third parties in identifiable form.

We implement appropriate technical and organisational measures to protect your data against unauthorised access, alteration, disclosure, or destruction. Passwords are hashed using Argon2 and all data in transit is encrypted via TLS. No system is completely secure, however, and we cannot guarantee absolute security.
Your personal data is retained for as long as your account is active or as necessary to comply with legal obligations. When you delete your account all personal data is permanently removed within 30 days.
You may delete your account at any time from the Settings screen. We may suspend or terminate your account without notice if you violate these Terms or if we reasonably believe your use poses a risk to the Service or other users. Upon termination your right to use the Service ceases immediately.
In-app subscriptions (Apple App Store / Google Play): All subscription purchases are contracts concluded directly between you and Apple or Google as the platform operator. The right of withdrawal for these transactions is governed by Apple's and Google's own consumer terms, which comply with EU and German law. Please refer to their terms for withdrawal instructions and time limits.
Use of the free app: Where a distance contract for the use of the app itself exists, the statutory 14-day right of withdrawal (§355 BGB) applies from the day the contract is concluded. However, by creating an account and beginning to use the Service you expressly request immediate commencement of performance and acknowledge that your right of withdrawal expires once we have begun providing the digital content with your consent (§356 Abs. 5 BGB). Your acceptance of these Terms at sign-up constitutes this express request and acknowledgement.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service.
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Germany, unless mandatory consumer protection laws in your country of residence provide otherwise.
We may update these Terms from time to time. We will notify you of material changes via the app. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, please delete your account.
